Please read these Terms & Conditions (“Terms”) carefully before using our rental services. By renting a vehicle from Jom Car Rental (“the Company”), you agree that you have read, understood, and accepted these Terms. If you do not agree, please do not proceed with the rental.

1. Limitation of Liability

1.1 If Jom Car Rental cannot provide services due to a Force Majeure Event, the Company shall be exempted from all obligations under these Terms.
1.2 The Company is not liable for service disruptions caused by any act or omission of the Renter.
1.3 Services are provided on an “as is” and “as available” basis without any guarantees, conditions, or warranties. To the maximum extent permitted by law, the Company excludes all implied conditions and shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to personal injury, loss of life, profits, data, goodwill, or reputation.
1.4 Liability, if any, shall be capped at the total rental fees paid in the preceding 30 days.
1.5 The Company is not responsible for any dealings or transactions between the Renter and third parties.

2. Prohibited Use of Vehicles

Vehicles shall not be used for:

• Any illegal or unlawful purposes under Malaysian law.

• Morally objectionable or prohibited purposes.

• Driving outside Malaysia (including Singapore, Thailand, Brunei, Sabah, Sarawak, Labuan, Langkawi, Redang, Tioman, Pangkor, etc.).

• Driving off-road, on unsealed roads, or transported by boat/ship.

• Ride-hailing/ridesharing (Grab, InDrive, etc.) without prior written approval.

• Carrying drugs, alcohol, weapons, illegal goods, or items with strong odour (e.g. durians, raw meat, pets).

• Smoking or vaping in the vehicle.

• Overloading passengers beyond seating capacity.

• Towing vehicles/objects or carrying heavy goods.

• Subletting, hiring, pledging, or selling the vehicle.

• Using in races, rallies, contests, or reckless driving.

• Permitting unregistered drivers to operate the vehicle.

• Removing, damaging, or altering any company-installed parts or devices.

Any breach gives the Company the right to immediately terminate the rental and forfeit deposits.

3. Returning of Vehicle

• Vehicles must be returned on or before the agreed date/time at the designated location.

• No refunds for early return.

• Vehicle must be returned in clean condition and same fuel level.

  • RM500 cleaning penalty for smoke odour/ashes.

  • RM20 admin fee + fuel cost if returned with less fuel.

  • RM1,000 relocation fee if returned to a non-designated location.

• Grace period: 45 minutes. After that, hourly charges apply.

• Extensions must be requested at least 24 hours in advance. Less than 24 hours = penalty.

4. Security Deposit

• A refundable deposit is required, amount depending on vehicle type.

• Deposit will be refunded:

  • Foreign clients: upon return if no damage/summons.

  • Local clients: within 7–14 working days.

• Deposit may be forfeited for damages, summons, or breaches.

5. Breach of Contract​

The Company reserves the right to:

• Terminate rental immediately and repossess the vehicle without notice.

• Forfeit all payments and deposits.

• Pursue recovery of damages, unpaid balances, and legal costs.

6. Rental Charges

• Rental is calculated per 24-hour cycle.

• Daily, weekly, and monthly rates apply depending on booking length.

• Excess mileage charged at RM0.20 – RM1.00/km depending on vehicle.

• No rebates/refunds for early return.

• Cancellation policy:

  • Within 24 hours of booking → full booking fee forfeited.

  • No show or same-day cancellation → 100% rental charged.

7. Exclusions (Not Covered by Rates)

Renter is liable for:

• Interior cleaning & upholstery if returned dirty.

• Interior damages to instruments, fittings, electronics.

• Lost/damaged accessories (e.g. GPS, child seat, spare tyre, tools, keys).

• Lost vehicle keys (replacement cost + reprogramming).

• Personal belongings left inside the vehicle (Company is not liable).

8. Speed Limit

• Maximum speed: 110 km/h on highways and 90 km/h on federal roads.

• Each violation detected via GPS/Speed Tracker → RM100 penalty.

9. Parking Fees, Tolls, & Summons

• Renter is responsible for all parking, tolls, and summons.

• Additional RM100 admin fee applies if Company settles a summons.

10. In Case of Accident

• Notify the Company immediately via Call/WhatsApp (011-3535 1012) with photos.

• Make a police report within 24 hours.

• No unauthorized repairs allowed without Company consent.

• Insurance only covers third-party damages, not passengers.

• Failure to report/comply → minimum RM500 admin fee + full liability.

11. Stolen Vehicle

• Renter must report immediately to Company + police within 24 hours.

• Renter liable for loss of use, bank installments, and full recovery costs.

12. Insurance Coverage

• Includes third-party liability only.

• Does not cover single-vehicle accidents, tyres, underbody, windscreen, or negligence.

• Renter liable for damages up to insurance excess based on vehicle type.

​

13. Additional Conditions

• Child seat rental: RM20 per booking (RM500 penalty if lost/damaged).

• Delivery/collection fees apply based on distance. Extra RM50 outside office hours.

• Additional drivers: RM50 each (must be registered). Unauthorized drivers → penalties.

• Long-term rentals (3+ months): one-month deposit required, no early termination.

• Late monthly payment: 10% interest charge per month.

• Vehicle inspection is required at collection; unreported damage will be renter’s liability.

• Minimum rental age: 21 years old with valid local or international license.

14. Car Damages & Repairs

• Minimum RM350 for minor scratches/damage.

• RM500 per panel for repaint/denting.

• All towing/impound costs due to renter’s fault are renter’s responsibility.

15. Zero Tolerance Policy

Jom Car Rental maintains a strict zero tolerance for:

• Verbal abuse, insults, threats, vulgar language.

• Physical aggression or harassment.

• Disrespectful behavior towards staff.

Violations result in:

• Immediate termination without refund.

• Permanent ban from future rentals.

• Legal action where applicable.
