JOM CAR RENTAL — TERMS & CONDITIONS
Welcome to JOM Car Rental (“JOM”, “we”, “our”, or “us”). By renting or using a vehicle from JOM, you agree to comply with the following Terms and Conditions. Please read them carefully before signing your rental agreement or taking delivery of any vehicle.

1. Eligibility to Rent
1. You must be at least 20 years old (or 25 for premium vehicles).
2. You must hold a valid full driving licence for at least one (1) year.
3. Probationary (P) licences are not accepted.
4. International renters must present a passport and a valid foreign licence (with English translation or an International Driving Permit if required).
5. We may refuse rental if your driving record or identification does not meet our requirements.

2. Booking and Payment
1. Bookings can be made via our website, WhatsApp, phone call, or authorised agents.
2. A deposit or full payment is required to confirm your reservation.
3. Accepted payment methods include cash, credit/debit card, or online transfer.
4. Prices quoted are in Malaysian Ringgit (RM) and include government taxes where applicable.
5. JOM reserves the right to cancel a booking if payment is not received on time or if vehicle availability changes due to unforeseen circumstances.

3. Security Deposit
1. A security deposit is required before the vehicle is released. The amount varies by car type.
2. The deposit covers possible fines, damages, fuel shortage, or late return fees.
3. After returning the car in good condition, your deposit will be refunded within 7–10 working days.
4. Deductions may be made for unpaid tolls, traffic summons, damage, or missing items.

4. Rental Duration & Vehicle Return
1. The minimum rental period is 24 hours.
2. Late returns exceeding 1 hour may be charged RM20–RM50 per hour, depending on the car model.
3. Extensions must be requested and approved before your rental ends.
4. Vehicles must be returned to the agreed location and in the same condition as received.
5. If the car is not returned on time and no communication is made, JOM reserves the right to report the case to the authorities.

5. Fuel Policy
1. All vehicles are provided with a specific fuel level at the time of pick-up.
2. The same fuel level must be maintained when returning the vehicle.
3. If fuel is insufficient upon return, a refueling charge plus service fee will apply.

6. Vehicle Use
You must use the vehicle responsibly and in accordance with Malaysian law. The car must not be used for:
• Racing, off-road driving, or towing.
• Carrying passengers or goods for payment.
• Carrying any drugs or illegal objects in the Vehicle
• Driving under the influence of alcohol or drugs.
• Any unlawful act or in restricted areas without permission.
• Crossing the Malaysian border without written consent.
You are fully responsible for any damage or legal issues arising from misuse or prohibited activity.

7. Insurance & Liability
1. All vehicles come with basic insurance coverage for third-party liability.
2. In case of accident, damage, or theft, the renter must immediately notify JOM and make a police report within 24 hours.
3. Failure to report within the given time may result in the renter being fully liable for all losses.
4. Optional Liability Reduction (LRO) or additional coverage may be offered — please ask at booking if available.
5. Insurance does not cover damage to tyres, rims, glass, undercarriage, interior, or negligence-related incidents.

8. Accidents or Breakdown
1. If an accident occurs, do not admit fault or negotiate privately. Contact JOM immediately.
2. For breakdowns, call our 24-hour helpline listed on your rental document.
3. JOM will provide assistance, repair, or replacement vehicle depending on circumstances.
4. Replacement vehicles are subject to availability and location.

9. Traffic Summons & Fines
1. You are responsible for all traffic offences, parking tickets, toll charges, and summonses during your rental period.
2. If JOM receives a notice for offences during your rental, the amount plus an administration fee (RM50–RM100) will be deducted from your deposit.

10. Cancellation & Refund Policy
1. Free cancellation is allowed at least 24 hours before the pick-up time.
2. Cancellations within less than 24 hours may incur a one-day rental fee as penalty.
3. No refund will be issued for:
• “No show” or last-minute cancellations.
• Early return before the agreed date.
4. Refunds (where applicable) will be processed within 5–10 working days to your original payment method.

11. Vehicle Condition & Cleaning
1. The car must be returned in clean condition.
2. Excessive dirt, stains, or smoking inside the vehicle will result in a cleaning fee of RM150–RM300.
3. Lost accessories (e.g., SmartTAG, GPS, keys) will be charged at replacement cost.

12. Company Rights
1. JOM reserves the right to decline or cancel any booking at our discretion.
2. We may terminate your rental agreement without refund if the car is used in violation of these Terms.
3. We may track the vehicle using GPS if necessary for safety, theft prevention, or misuse investigation.

13. Limitation of Liability
1. JOM shall not be held responsible for any indirect loss, injury, delay, or inconvenience arising from vehicle use or breakdown.
2. Our total liability, if any, shall not exceed the amount paid for the rental period.

14. Personal Data Protection
1. Your personal details are collected for booking, security, and insurance purposes.
2. All data is handled according to the Personal Data Protection Act 2010 (PDPA).
3. We will not share your information with third parties except as required by law or insurance providers.

15. Governing Law
This Agreement shall be governed by and interpreted according to the laws of Malaysia. Any dispute arising shall be settled in the courts of Malaysia.
